It means that employers will see an additional $42 per employee that they have to pay at the end of the year. The Department of Labor announces at the end of each year which states are eligible to receive the full 5.4% tax credit. FUTA taxes are only paid by employers, which means individual taxpayers are not responsible for paying them. The FUTA tax rate is 6% and only applies to a certain dollar figure paid to employees during the year. Finally, if the FUTA credit reduction applies, they can enter the total on line 11. Federal Unemployment Tax Act (FUTA) and unemployment insurance (UI) are two different things. FUTA is a broad-based federal tax imposed on all employers that applies to the first $7,000 of wages paid to each employee in a calendar year.

FUTA Filing Dates

Which Wages Are Not Subject To FUTA Tax?

Certain state disability plan payments that your household employee may receive are treated as social security and Medicare wages. For more information about these payments, see the Instructions for Schedule H (Form 1040) and the notice issued by the state. However, any noncash wages you pay don’t count as social security and Medicare wages. If you need to pay social security, Medicare, or FUTA tax or choose to withhold federal income tax, read Table 2 for an overview of what you may need to do. When you hire a household employee to work for you on a regular basis, you and the employee must each complete the U.S.

Form 940 Instructions

To maintain compliance (and be prepared to pay), employers need to understand which taxes apply to them, how to calculate their liabilities, and when and how to make payments. For example, if an employer pays wages to their spouse, their parents, or their child who is under the age of 21, they will not be responsible for paying FUTA taxes on that portion of the money paid to their employees.

Go to IRS.gov/EmploymentEfile for more information on electronic filing. If you file a paper return, where you file depends on whether you include a payment with Form 940. Mail your return to the address listed for your location in the table that follows. Religious, educational, scientific, charitable, and other organizations described in section 501(c)(3) and exempt from tax under section 501(a) generally aren’t subject to FUTA tax. Count wages you paid to aliens who were admitted to the United States on a temporary basis to perform farmwork (workers with H-2A visas).

Covered businesses must record FUTA liabilities, remit taxes quarterly or whenever liabilities meet or exceed the $500 threshold, and file the Employer’s Annual Federal Unemployment Tax Return by the filing deadline.

For each wage payment, you will pay $15.30 when you pay the taxes. This is $7.65 ($6.20 for social security tax plus $1.45 for Medicare tax) to cover your employee’s share plus $7.65 ($6.20 for social security tax plus $1.45 for Medicare tax) for your share. For income tax purposes, your employee’s wages each payday are $107.65 ($100 + the $7.65 you will pay to cover your employee’s share of social security and Medicare taxes).

If you prefer to pay your employee’s social security and Medicare taxes from your own funds, don’t withhold them from your employee’s wages.
